1. Acceptance of Terms
By downloading, installing, or using the Whisp macOS application ("Whisp", "App", or "Service") provided by Horizam ("we", "us", or "our") accessible at whisp.horizam.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not install or use Whisp.
2. Description of Service
Whisp is a native macOS productivity tool that provides on-device speech-to-text dictation using Apple's built-in Speech framework. Whisp offers a floating interface that allows users to dictate text and inject it into active applications, terminal windows, code editors, and browsers.
3. 7-Day Free Trial & Lifetime License
7-Day Free Trial: Whisp offers a 7-day free trial granting full, unrestricted access to all features upon initial installation. No credit card is required to begin the local trial.
Lifetime License ($9.99 USD): Upon conclusion or during the trial, users may purchase a non-consumable Lifetime License for a one-time fee of $9.99 USD via Apple In-App Purchase (StoreKit). This license grants permanent, perpetual access to Whisp on any compatible Mac device associated with your Apple ID. There are no recurring subscription charges.
Price Changes: We reserve the right to modify pricing for new purchases at any time. Existing lifetime license holders will retain full access without additional charges.
4. Software License & Restrictions
We grant you a non-exclusive, non-transferable, revocable personal license to use Whisp on macOS hardware owned or controlled by you in accordance with the Apple App Store Terms of Service. You agree not to:
- Reverse engineer, decompile, or disassemble the binary software, except where permitted by applicable law.
- Rent, lease, lend, sell, redistribute, or sublicense the application.
- Use Whisp for any unlawful, harassing, defamatory, or abusive purposes.
5. On-Device Processing & System Permissions
Whisp relies on macOS system permissions including Microphone access, Speech Recognition, and Input Monitoring (Accessibility) to perform direct input injection. Speech recognition is conducted locally via Apple Speech. Whisp does not maintain external speech processing servers and does not transmit your raw voice audio, dictated content, clipboard contents, or transcription history. Firebase Crashlytics may receive limited, sanitized crash diagnostics as described in the Privacy Policy.
6. Purchases, Billing & Refunds
All in-app purchases and payments are processed directly by Apple through the Mac App Store. Apple's standard terms, conditions, and refund policies apply to all transactions. If you seek a refund, you must request it directly through Apple via reportaproblem.apple.com.
7. Disclaimer of Warranties
Whisp is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. Speech recognition accuracy depends on hardware microphones, speech clarity, background noise, and macOS system software. We do not guarantee 100% error-free speech transcription or uninterrupted operation.
8. Limitation of Liability
In no event shall Whisp or Horizam be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising out of the use or inability to use the software.
9. Changes to Terms
We may update these Terms of Service periodically. Any modifications will be posted on this page with an updated revision date. Continued use of Whisp after changes constitutes acceptance of the new terms.
